The involvement of a third party debt collection

action to recover your money.
Pre-Legal Assessment
'Going
legal'
is not a course of action that should be taken lightly, and is in no way a
guarantee of success.
We don’t want our clients to spend their
money needlessly, so we’d always urge them to undertake a Pre-Legal Assessment
of a case to evaluate the debtor’s ability to pay should subsequent legal action
be successful. Our
Pre-Legal Assessment will consider your debtors current circumstances (such as
any other actions against them) plus their ability to pay, and give you our
opinion as to whether we believe progressing to legal action is likely to result
in a positive outcome for you.
Our Pre-Legal Assessments cost just £20 + VAT
(payable in advance) and could save you a considerable amount in potentially
expensive legal fees.

‘Pre-Legal’ to submit your instruction.
Taking Action
Advantis partner with a firm of solicitors who
upon your instruction will issue legal proceedings on your behalf through the
County Court, usually within 3 working days of receipt of your particulars and
fees.
If no defence to the claim is made by the debtor
within the timescale allowed by the Court and you have given us no instruction
to halt proceedings (for example, if the debtor has paid you), then we will
automatically ask the Court to grant Judgment to you.
The cost of issuing such proceedings is detailed
below.
In the event that you are successful, then all of
these costs will be added to the debt and are as such fully recoverable from the
debtor.
However, if your action is not successful then
you cannot recover these costs.

You’ll be asked to pay the appropriate fee
at the time of submission, and this can be paid by debt or credit card securely
online.

After Judgment
Gaining a successful County Court Judgment will
often result in payment finally being made by the debtor.
However, should they still refuse to pay
there are a variety of further actions that you can take to secure payment.
These include options such as charging
orders, attachment of earnings, third party debt orders or issuing a warrant of
execution where either High Court or County Court bailiffs will visit your
debtor to secure payment or seize goods to the value of the debt.
